JUDGEMENT

(1.) This C.R. No. 13334(W) of 1984 was transferred from High Court at Calcutta to this Tribunal u/s. 29 of the A.T. Act, 1985, and registered as T.A. No. 32 of 1988.

(2.) The facts of the case are that the petitioner was appointed as Sub -Inspector of Police in 1963, promoted to the post of Inspector of Police in 1973 and in 1977 was posted at Rangat.

(3.) While in Rangat, on 26.1.83, Republic Day Celebration was to held according to the scheduled printed programme which did not include ceremony like March Part. The applicant was entrusted with the responsibility of law and order and to ensure peaceful celebration of Republic Day in accordance with the scheduled programme. But one Sri A. P. Singh Dy. Police Officer wanted to have March Past but was prevented by the applicant. Thereupon Sri A. P. Singh abused the applicant and the Police Administration. The applicant lodged a formal complaint against Sri A. P Singh under Ss. 353, 294 and 188 of I.P.C., as a result, A. P. Singh was arrested on 27.1.83 by the Station Home Officer, Rangat and brought to the Police Station. On account of the aforesaid incident, there was a public agitation and the Police Station was attacked and some policemen were injured. Sri A. P. Singh was kept in the police lock -up but due to public agitation, he was ultimately released.
