JUDGEMENT

(1.) This first appeal is at the instance of a defendant in a suit for eviction and is directed against the judgment and decree dated 15th June, 2009 passed by a learned single Judge of this Court by which His Lordship passed a decree for eviction and mesne profits in favour of the plaintiffs-respondents.

(2.) Being dissatisfied, the defendant No. 1 has come up with the present appeal.
