JUDGEMENT

(1.) By consent of the learned Counsel appearing for the parties, this writ petition is being disposed of at this stage only without calling for any affidavit.

(2.) The petitioner at the relevant point of time was working as a bus conductor of South Bengal State Transport Corporation. He met with an accident on 26th July, 2004 in course,6f discharging his duties. THE claim of the petitioner is that after such accident, he suffered fracture in his left hand and it is not possible for him at this stage to discharge his normal duties as a conductor.

(3.) The Superintendent of SSKM Hospital is directed to constitute Medical Board for this purpose and examine the physical ability of the petitioner for discharging his duties as a bus conductor. THE Superintendent of SSKM Hospital shall be at liberty to select the doctors for the purpose of constituting the Board in this regard. Such Board shall be constituted within a period of three weeks from the date of communication of this order and the decision of the Board shall be given within a further period of six weeks. Such decision shall be communicated to the petitioner as well as Corporation. Based on such decision the respondent-Corporation shall allocate duty to the petitioner.
