JUDGEMENT

(1.) This writ application is directed against the order dated 20.1.99 passed by the West Bengal State Administrative Tribunal in T.A. No.449 of 1997 whereby and whereunder the petitioner's application was dismissed. The petitioner had earlier filed a writ application before this court and by an order dated 28th June, 1997 a learned single Judge of this court directed:

(2.) The petitioner in the meantime retired from service. He had been given an opportunity of hearing by the Superintendent of Police. The Superintendent of Police in his order dated 6.8.94 recorded:

Supplementary affidavit was filed by the petitioner before the learned Tribunal questioning the said order, inter alia, on the ground that the Superintendent of Police did not consider the provision of Rule 9(5) of the West Bengal Service Rules, Part-I as was directed to be done by this court in its order dated 28th June, 1994.
