(1.) THE parties in above referred revisions are same and also the revisions are arising out of the order passed by the Labour Court, issuing process against the Applicant i.e. original Accused. As the common point is involved in all the matters, they are decided by this common order. The present complaint is filed by Shri S.N. Paithankar, the Inspector of the Bombay Iron and Steel Board, Bombay against M/s. Malhotra Steel Industries, Gujarat Pvt. Ltd., and its partner, for the offence punishable U/s. 44 of the Bombay Iron and Steel Unprotected workers (Regulation of Employment and Welfare) scheme 1970 read with Clause 14 of the said scheme and U/s. 33 of the Maharashtra Mathadi, Hamal and other Manual Workers (Regulation of Employment and Welfare) Act, 1969.
(2.) IT is stated that the Respondent is carrying business of manufacturing of round bars, equal angles, C.T.D. bars etc. In its factory. Under clause 14 of the said scheme every person engaged in manufacturing, purchasing, or trading in iron and steel material has to apply to the board for the registration within 30 days in prescribed form. The Complainant visited the premises on 18th November 1989 and found that 10 workers were loading manually beams in the establishment. About six workers were also manually loading the scrap. The accused was asked about the registration of the establishment with the board. Notice was replied by the accused. However, as there was a contravention, complaint is filed.
(3.) IN another complaint No. 5/90, the allegations are practically similar. Only that the premises was visited by the Inspector on 27th October 1989 and in complaint No. 4/90 it was visited on 18th November 1989.
