THESE Revisions are filed challenging legality of judgment and order passed in Complaint (ULP) No. 27 of 1986 by the Labour Court, Kolhapur, whereby an employer is directed to reinstate its employee with continuity of service, consequential benefits and one third back wages. Revision (ULP) No. 282/97 is filed by original Complainant employee challenging the finding that no enquiry was necessary as he admitted the charges and of refusal to pay full back wages. Revision Application (ULP) No. 328/97 is filed by original Respondent employer challenging reinstatement with continuity of service and payment of one -third back wages.

THE Petitioner of Revision (ULP) No. 282/97 who is Respondent of Revision (ULP) No. 328/97 (hereinafter referred to as original Complainant) filed above complaint on 3rd April, 1986 against the Respondent of Revision (ULP) No. 282/97 who is the Petitioner of Revision (ULP) No. 328/97 (hereinafter referred to as the Bank) alleging unfair labour practices under item 1(a), (b), (d), (f) and (g) of Sch. IV of the M.R.T.U. & P.U.L.P. Act, 1971.

IT is case of the Complainant that he realised, while serving at Nandre and Islampur Branch, that his honest and sincere efforts to increase Bank's business are of no value to higher authorities of the Bank and his disciplinary mode of following strict procedural rules was unliked by them. He refused to flow illegal directions of Bank's Higher Authorities. Eventually, the Authorities started harassing him on one pretext or the other and threatened him dire consequences, on failure to obey them.
