JUDGEMENT

(1.) The petitioner has challenged an order dated 05.08.2019 passed by the licensing authority, Sub-Divisional Magistrate, Sonamura, Sepahijala district by which he is directed to handover all registrars and other documents and to file reply and show cause why action for alleged irregularities in running a fair price shop should not taken against him. This order is challenged primarily on ground of lack of authority to suspend the license of the petitioner. However, during the course of the arguments, it appeared that the respondents have not conveyed to the petitioner the alleged irregularities, based on which any further order of cancellation of license for fair price shop would be taken.

(3.) Shereas, the discrepancies found are of similar nature for which the dealer of Bashpukur-1 F.P.Shop Sri Suleman Miah had been previously suspended. Unfortunately, Sri Suleman Miah has been continuing the same malpractices for which he was booked earlier.
