(1.) Heard Mr. S. Deb, learned Sr. counsel assisted by Mr. B. Debnath, learned counsel appearing for the petitioners as well as Mr. D. Sharma, learned Addl. G.A. appearing for the State- respondents and Mr. B.N.Majumder, learned counsel appearing for the Tripura Industrial Development Corporation Limited (TIDC Ltd.).

The present case, in a short compass, is that the petitioners are holding the posts of General Manager under the TIDCL and being the General Managers of TIDCL, they have claimed that their pay scale should be equated with that of the pay scale of the General Managers of Tripura State Electricity Corporation Limited (TSEC Ltd.). As a policy matter the claim of the petitioners was considered by the Board of Directors of the TIDC Ltd. The relevant excerpts of the Board of Directors taken on 26 th November,2012 is reproduced herein below:
(3.) Managers in the pay scale of Rs.10,650/- -- 15,850/- ( Pre Revised) (Revised scale: 13,575/- -- 37,000/-, GP: 4,800/-) ........ ....... .......... RESOLUTION: RESOLVED THAT the pay scale of General Managers in TIDC Ltd as approved earlier in the 75th, 78th and 135th Board meetings in the scale of Rs.14,150/- -- 20,000/- (Pre revised) (Revised scale: Rs.24,625/- -- 40,600/-, GP:6,500/-) be and is hereby approved considering the responsibility and complex nature of jobs involved and proposal for modification of pay scale be sent to Finance Department, Government of Tripura through the Administrative Department to keep parity with the other Corporations like TSECL etc." 3. In pursuance of the said decision of the Board of Directors, the Managing Director of TIDC Ltd. had made a communication to the Director, Directorate of Industries and Commerce, Govt. of Tripura, Agartala vide communication dated 4th January, 2013 wherein he stated that-- "It is also worth mentioning that there appears to be some discrimination between the scales of General Manager, TIDC and General Manager, TSECL, though the responsibilities of GM, TIDC is also of paramount importance in steering the Corporation to touch new horizons of success. Considering the importance of the post of General Manager in TIDC, Board has agreed and approved to upgrade the scale keeping parity with the scale of General Manager, TSECL. You are therefore, requested to kindly take up the matter with the concerned Authority for upgradation of scale from Rs.13,575/- -- 37,000/- with GP of Rs.5,600/- to Rs.24,625/- -- 40,600/- with GP of RS.6,500/- for General Managers of TIDC to keep parity with the post of General Managers of TSECL."
