(1.) Heard Mr. N. Choudhury, learned GA appearing for the respondent-petitioner, who has filed this petition for extending time for implementation of the judgment and order dtd. 28/9/2018 delivered in WP(C) No.1559 of 2017 [Bijoy Biswas and Ors v. The State of Tripura and Ors.] The objection which could not be filed in the Registry has been taken on record. By the said judgment, this court had occasion to observe as follows:

According to Mr. Choudhury, learned GA for proper implementation of the judgment, the standard norms of output per day per labour has to be re-determined, else the State would suffer serious prejudice and be saddled with additional financial burden to the extent of Rs.19.00 crores. Mr. Kar Bhowmik, learned counsel appearing for the writ petitioner-respondent has submitted that regarding the standard norms of output, the State can follow the similar determinant as in force in various other State or Central Godown. For example, Mr. Kar Bhowmik, learned counsel has referred to the notification dtd. 24/10/2017 (Annexure-B to the objection field by the writ petitioner-respondents). Mr. Kar Bhowmik, learned counsel has further submitted that the said notification had been annexed with the writ petition being Annexure-6.
(3.) Be that as it may, this court is not at all satisfied with the reasons as provided for seeking extension of time. Already, the respondents have lost more than 3(three) months for implementation of the judgment, as the judgment had clearly stipulated that the direction of the court has to be complied within 3(three) months from the date of the receipt of the copy of this order, but a precise date has been prescribed thereby. Be that as it may, having considered the various facts involved in building up a mechanism, the time is extended till 31/1/2019 and the respondent-petitioners shall operationalize the new system as indicated in the said judgment. Else, the stern action will be taken against the State for disobeying the direction of this court on reference.
