JUDGEMENT

(1.) The appellant has prayed for the following relief:

(2.) The appellant-claimant lays challenge to the award dtd. 10/1/2018 passed by Motor Accident Claims Tribunal, Court No.2, West Tripura, Agartala in TS(MAC) No.238 of 2014, titled as Partha Sarathi Bhattacharjee v. Shri Jayanta Majumder and Others on two grounds:

(3.) Certain facts are not in dispute. On 23/6/2013, claimant, Shri Partha Sarathi Bhattacharjee met with a motor vehicular accident; the fault being purely that of the person who was driving the vehicle bearing registration No. TR-01-AC 0492, owned by Shri Jayanta Majumder; as a result of such accident, claimant sustained injury and had to undergo medical treatment at Agartala, Kolkata and Manipal Hospital, Bengaluru.
