JUDGEMENT

(1.) The petitioner is a judicial officer and a member of the Tripura Judicial Service Rules, 2003, joined service in Tripura Judicial Service Grade-III on 30th December, 2003. The judicial officer in Grade-III becomes eligible for promotion to Grade-II having five years of service to his credit on the basis of the criteria indicated in Schedule-C appended to Tripura Judicial Service Rules, 2003 (hereinafter referred to as the Rules, 2003). Schedule-C relevant for the purpose lays down the general criteria for promotion and the criteria from Grade-III to Grade-II in particular to which we are presently concerned is reproduced hereunder: "Schedule-C General Criteria for promotion:
