JUDGEMENT

(1.) Heard Mr. P. Sen Choudhury, learned counsel appearing for the applicant. Also heard Mr. S. Ghosh, learned Addl. P.P. appearing for the respondent-State.

(2.) This is an application filed under Sec. 439 of Cr.P.C. praying for granting bail to the accused namely, Md. Raju Miah, who was arrested in connection with West Agartala Women Police Station crime No.2018 WAW 005 [S.T. (Type-1) 97 of 2021] for committing offences punishable under Ss. 366/376(2)(n) of IPC.

(3.) On perusal of the records, it is found that the accused, Md. Raju Miah was granted bail by the learned Judicial Magistrate 1st Class, Agartala, West Tripura vide order dtd. 12/2/2018. He was arrested on the basis of an F.I.R. lodged by his wife Sayera Begam on the allegation of being involved in physical relation with her without her consent.
