(1.) By means of this petition the petitioner has prayed that the Rules whereby the post of Superintendent (Sales Emporia) has been excluded from the feeder category for promotion to the post of Industrial Development Officer be quashed and set aside.
(2.) The undisputed facts are that earlier the Directorate of Handloom, Handicrafts and Sericulture was part of the Directorate of Industries and Commerce. It appears that on 1st August 1987 a separate Directorate of Handloom, Handicrafts and Sericulture was created. Though on paper there was a bifurcation of the two Directorates, it appears that the Directorate of Industries and Commerce continued to function like the parent or guardian directorate.
(3.) On 29.12.1989 the petitioner, Purabi Chakraboty was offered appointment as Senior Instructor (English) in the Directorate of Industries and Commerce and she joined on the said post on 2nd April, 1990. Thus it is apparent that she joined the directorate after the bifurcation of the Directorate of Industries and Commerce into two different directorates. After the bifurcation of the directorate took place, on 22.04.1989 i.e. before the appointment of the petitioner a memo was issued, relevant portion of which reads as follows:
