(1.) This present application has been filed under Sec. 438 of the Code of Criminal Procedure for releasing the accused petitioner on pre-arrest bail in connection with East Agartala P.S. Case No.2023/EAG/071 under Sec. 302/201 of IPC. The fact of the case in short is that the petitioner herein is a permanent resident of Chanpur under East Agartala Police Station, the petitioner is a Bachelor of Arts graduate from MBB College in 2019. In connection with the above-mentioned case, the police visited the house of the petitioner herein but the petitioner was not found in his house. The petitioner herein apprehending his arrest has filed his present pre-arrest bail petition.
(2.) Heard Mr. D.C. Roy, learned counsel appearing for the petitioner as well as Mr. R. Datta, learned P.P. appearing for the State-respondent. Mr. Roy, learned counsel appearing for the accused petitioner submits that the petitioner is an innocent person and has been falsely implicated by the complainant and he has no connection with the deceased-Dipankar Ghosh. Learned counsel further submitted that the accused petitioner herein is ready to cooperate with the investigating agency. On the other hand, learned P.P. opposed this present application and urged this Court to dismiss this instant application as the custody and interrogation of the accused-petitioner is required for proper investigation of the matter.
(3.) Heard both sides and perused the evidence on record. In view of the present circumstance that the accused-petitioner herein is ready to cooperate with the investigation, this Court is inclined to allow this present anticipatory bail application. Accordingly, the accused-petitioner herein is granted pre-arrest bail on furnishing a bond of Rs.50,000.00 with 2(two) sureties of like amount to the satisfaction of the concerned authority. However, the accused-petitioner herein shall cooperate with the investigation as well as the interrogation from 10.00 A.M. to 5.00 P.M. with the concerned SHO for a period of 7(seven) days that is from 5/7/2023 to 11/7/2023. Failing such condition, this anticipatory bail granted to the petitioner stands automatically canceled and the investigating officer is at liberty to take appropriate steps in accordance with law. With the above observation and direction, this present application stands allowed and thus disposed of.
