(1.) Heard Mr. Somik Deb, learned senior counsel assisted by Mr. P. Chakraborty, learned counsel appearing for the petitioner. Also heard Mr. K. Nandi, learned counsel appearing for the respondent nos. 1 to 4; Mr. P. Saha, learned counsel appearing for the respondent nos. 6 and 7 and Ms. V. Podder, learned counsel appearing for the respondent no.8.
(2.) Here, the question arises whether this Court can pass any direction about the apportionment of the disbursed amount by one of the co-sharers out of the income and the deposits left behind by their deceased father.

It is the settled proposition of law that a nominee only can withdraw the money, but, it has to be apportioned between all the co-sharers and in that case, this Court cannot decide the disputed questions and for this, remedy lies in the Civil Court. The legal heirs of the deceased father may file an appropriate suit to settle their disputes, which is not possible to adjudicate in exercise of this Court's jurisdiction under Article 226 of Constitution of India.
