(1.) Heard Mr. R. Datta, learned counsel appearing for the petitioner as well as Mr. B. Majumder, learned ASGI appearing for the respondents No.1, 2, 3 and 4, whereas Mr. D. Sharma, learned Addl. G.A. appearing for the respondents No.5 and 6.

The petitioner namely Teesta Petrotech Private Limited, a company registered under Companies Act, 1956 has been running the business of CNG cylinder testing station being approved and licensed by Petroleum and Explosives Safety Organization, Government of India. The petitioner has been testing the CNG cylinders for the last three years and the petitioner has claimed that they have been discharging their responsibilities with utmost honesty and integrity, and in compliance of Gas Cylinder Rules, 2016 and Explosives Act, 1884.

The respondent No.3, by the letter dated 06.09.2019, gave a show-cause notice to the petitioner for explaining why action will not be taken against him for activities in deviation of the Gas Cylinder Rules, 2016. The communication dated 06.09.2019 Annexure-1 to the writ petition is a sort of show-cause notice. Till the inspection, the Deputy Chief Explosives Controller, Guwahati found no record of CNG cylinders tested or deposited for testing in the premises. Even during their inspection, no personnel was available in the said testing station at Agartala.
