KAMAL SINGH Vs. THE STATE OF MADHYA PRADESH

JUDGEMENT

(1.) This is second application filed by applicants Kamal Singh and Shivkripal under Section 439 of the Cr.P.C. for grant of bail in connection with Crime No.367/2018 registered at Police Station Raatibadh, District Bhopal for the offence punishable under Sections 302 , 307 , 323 , 147 , 148 , 149 , 326 of the IPC and Section 25 of the Arms Act.

(2.) Earlier bail application filed by the applicants was dismissed on merit by this Court vide order dated 13/02/2019 passed in M.Cr.C.No.5084/2019.

(3.) As per prosecution case on 10/11/2018 at about 9:00 A.M. applicants and co-accused Dr. Sanjay Shrivastava, Sunil Sharma, Mohan Meena and Brindavan Meena armed with stick and sword came to the spot and assaulted Malaram by stick and sword. When Ranchod came to rescue him, applicants and co-accused persons also assaulted him. Due to the injuries sustained by Malaram in the incident he died.
