JUDGEMENT

(1.) Heard with the aid of case diary.

(2.) This is first application under Section 438 of Cr.P.C. as the applicant apprehends his arrest in connection with Crime No.28/2019 registered at Police Station Patan, District Jabalpur (M.P.) for the offences punishable under Section 34(2), 42 of the M.P. Excise Act.

(3.) As per prosecution case on 17.1.2019 on the information of informant the Police stopped the motor cycle bearing registration No.M.P.-20 ND - 6243 and seized 55.260 bulk litres of country made liquor, which was illegally being carried by co-accused Amit Usrethe on the aforesaid bike. On interrogation, co-accused informed that he purchased the said liquor from the applicant. On that, police also implicated the applicant in the crime.
