JUDGEMENT

(1.) This first application under Section 439 of Criminal Procedure Code, 1973 has been filed by applicant, who is implicated in connection with Crime No.1303/2019 registered at Police Station Excise Circle, Bhikangaon, District Khargone (MP) for offence punishable under Sections 34(2) and 34(1)(a) of the Madhya Pradesh Excise Act, 1915.

(2.) The applicant is in custody since 12.11.2019.

(3.) As per prosecution story, on the basis of source information, 54 bulk liters of illegal liquor has been seized from the possession of the present applicant, for which he was not having any valid license. Hence, the applicant has been made as an accused in the case.
