JUDGEMENT

(1.) The petition is listed for admission but with the consent of the parties, is heard and decided finally. This petition has been filed by the petitioner being aggrieved by order dated 5.10.2018 passed in O.A. No.200/01045/2016, whereby the Tribunal has dismissed the original application filed by the petitioner praying for quashing order dated 14.7.2016 passed by the respondent authorities holding that the qualification possessed by the petitioner was not equivalent to the qualification prescribed for appointment on the post of Examiner Engineer and rejected the candidature of the petitioner.

It is submitted by the learned counsel appearing for the petitioner that the petitioner had applied for appointment on the post of Examiner Engineering (Semi Skilled), Group-C post, pursuant to the employment notification issued by the respondents in March, 2011. It is submitted that the petitioner is a holder of Diploma in Mechanical Engineering from Board of Technical Examination, Maharashtra and, therefore, fulfills the necessary eligibility qualification prescribed by the authorities for appointment on the post of Examiner Engineer.

It is stated that though initially the petitioner's name was mentioned in the select list, however, subsequently, the authorities rejected the candidature of the petitioner on the ground that he did not possess the necessary qualification, being aggrieved by which he had filed O.A. No.386/2012 before the Central Administrative Tribunal, Bench at Jabalpur, which was dismissed. It is stated that subsequently the petitioner had filed a review application which was registered as Review Application No.25/2013, and was disposed of with a direction to the respondents i.e. General Manager, Vehicle Factory, Jabalpur, to consider the claim of the petitioner in accordance with the prescribed qualification notified in the advertisement.
