JUDGEMENT

(1.) The petitioner has filed the present petition being aggrieved by the order dated 28.06.2017, passed by the Additional Commissioner Ujjain Division whereby order dated 29.03.2016 passed by the Collector District Mandsaur has been set aside.

Facts of the case, in short, are as under: The District Program Officer integrated Child Development Services, Mandsaur issued a common advertisement for inviting application to the post of Anganwadi worker, Assistance for the Centre/Ward No.10. On the basis of applications received, the Project Officer Sitamau No.2 issued the provisional selection list on 14.09.2015. A notice has been issued inviting objections on or before 22.09.2015 at 5 PM. In the provisional list, name of respondent No.6 Anita Parmar was placed at Serial No.1 by securing highest marks i.e. 52.10. The present petitioner submitted an objection on 23.09.2015 in respect of non grant of 10 marks on the basis of BPL certificate. The District Selection Committee in its meeting held on 05.11.2018 considered the objections of petitioner and other candidate and recommended for grant of 10 marks to the petitioner. After getting 10 marks, the petitioner secured 54.40 marks and accordingly appointment order dated 20.11.2015 was issued in her favour. The petitioner gave her joining on 23.11.2015 in the Project Office and since then she is working as Anaganwadi worker.

(3.) Being aggrieved by the appointment of the petitioner the respondent No.6 preferred an appeal before the Collector, Ujjain. The learned Collector after appreciating the material came on record came to the conclusion that the present petitioner being a BPL card holder was entitled to get 10 marks and according to which she has rightly been appointed. Vide order dated 29.03.2016, the Collector has dismissed the appeal.
