JUDGEMENT

(1.) Heard with the aid of case diary.

(2.) This is first application under Section 439 of the Cr.P.C. for grant o f bail. Applicant Aman Biraha was arrested on 29/08/2019 in connection with Crime No.410/2019 registered at Police Station Ranjhi, District Jabalpur for the offence punishable under Section 34 (2) of the M.P. Excise Act.

(3.) A s per prosecution case on 17/07/2019 on information of the informant Police went to Katni Dafai, Purani Basti, Ranjhi, Distt. Jabalpur and seized 60 bulk liter country made liquor from the possession of co-accused Ankit @ Monu, which was illegally kept by him in his possession. At the time of incident, applicant Aman Birha was also present on the spot, who fled away from the spot and Police arrested the applicant on 29/08/2019.
