JUDGEMENT

(1.) Learned counsel for the rival parties are heard and perused the case diary.

Present appeal has been filed under Section 14-A (2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for brevity 'the Atrocities Act') against the order dated 25.04.2019 passed by Special Judge (Atrocities), Datia, whereby the application of the appellants under Section 438 of Cr.P.C. seeking anticipatory bail has been rejected in connection with Crime No.53/2019 registered at Police Station Jigna, District Datia for the offence punishable under Sections 341, 294, 323, 324, 506-B/34 of IPC and section 3(1)(da)(kha) and 3(2) (V)(A) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

As per prosecution story, the complainant Manjesh Ahirwar made oral report along with his uncle at police station alleging that on 19.04.2019 when he was coming back to his village Salaiya Pamar on his motorcycle from village Danga Karera after attending the marriage ceremony of relative, then near Govt. School Salaiya Pamar, appellants and other co-accused persons stopped him and started hurling abusive words"Chamara wale bada neta banta hai". When he objected, accused Narendra Singh caused injuries to him by stone on his head, due to which blood was oozing and Raghavendra caused injury to him by rod on left elbow. The accused persons also threatened him that if he made complaint against them in the police, he shall face dire consequences.
