JUDGEMENT

(1.) This is third repeat bail application under Section 439 of Cr.P.C. for grant of bail.

(2.) The applicant has been arrested on 11/04/2017 in connection with Crime No. 80/2017, registered at Police Station Bagchini, District Morena for the offences punishable under Sections 302, 307, 336, 147, 148 and 149 of IPC.

(3.) It is submitted by the counsel for the applicant that till today not a single material witness has been examined and the complainant and his witnesses have deliberately did not appear before the Trial Court inspite of clear undertaking given by them before this Court and accordingly, this Court by order dated 04/09/2019 passed in MCRC No. 36404/2019 has granted bail to co-accused Monu @ Munendra Sikarwar, whose case is identical from the present applicant.
