JUDGEMENT

(1.) The petitioner has filed the present petition being aggrieved by action of the respondent No.1 by which she has been denied the seniority w.e.f. 25.2.1992 on the post of Clerk.

(2.) The petitioner was initially appointed as 'Beldar' in Contingency Establishment on 24.11.1981. Thereafter, vide order dated 8.6.1983 she was made permanent. By order dated 25.4.1987, she was sent on deputation against the post of OSD Project Community Organiser. During the period of deputation, respondent No.1 issued promotion order dated 25.2.1992 by which 12 Class IV employees were promoted to the post of Clerk from the date of their joining. Petitioner was placed at Serial No.7 in the list of promotion order and it is mentioned against her name that she is on deputation in Health Department.

(3.) After completion of deputation period, the petitioner was repatriated to her parent department i.e. Indore Municipal Corporation on 4.10.1997. Respondent published the gradation list of Clerks in the year 2010-2011 in which name of petitioner was placed at Serial No.219 on the basis of date of joining as Clerk on 4.10.1997.
