JUDGEMENT

(1.) The petitioner has filed the present petition being aggrieved by order dated 12.11.2018, passed by the returning officer Constituency 184 Kasrawad.

(2.) According to the petitioner Election Commission of India has declared the schedule for General Election of Legislative Assembly M.P. 2018 in the month of October November, 2018 by issuing a gazette notification dated 2.11.2018 and 09.11.2018. As per the election programme, the last date of nomination was 09.11.2018 and last date of scrutiny of nomination was 12.11.2018. The respondent No.5 submitted the nomination for contesting the election sponsored by Indian National Congress.

The petitioner being an authorized election agent of candidate belonging to BJP namely Mr. Atmaram Patel has submitted an objection in respect of incorrect and incomplete information furnished by the respondent No.5 in his affidavit appended along with the nomination form. The returning officer has started the scrutiny of all the nomination at 11.00 AM and concluded at 11.30 AM. By order dated 12.11.2018, he has rejected the objection of the petitioner as the same was submitted on 12.08.2018 at 11.45 AM. Thereafter, he has declared the list of 12 candidates eligible for contesting in the election.
