URVESH SAMADHIYA Vs. THE STATE OF M.P.

JUDGEMENT

(1.) This is 4th repeat bail application u/S. 439 Cr.P.C . filed by the petitioner for grant of bail after rejection of earlier one which was dismissed on merits with liberty to the petitioner to come again after examination of eye-witness Hariom.

(2.) The petitioner has been arrested on 22/2/17 by Police Station City Kotwali District Bhind in connection with Crime No. 565/2016 registered in relation to the offences punishable u/S. 302, 34 of IPC .

(3.) Learned Public Prosecutor for the State opposed the application and prayed for its rejection by contending that on the basis of the allegations and the material available on record, no case for grant of bail is made out.
