JUDGEMENT

(1.) Heard with the aid of case diary.

(2.) This is first bail application under Section 439 of Cr.P.C. Applicant Chirag Patel has been arrested in Crime No.02/2018 registered at Police Station Motinagar, Distt. Sagar (M.P.) for the offences punishable under Sections 365 / 34 and 195 (Ka) of the IPC.

(3.) As per prosecution case, on 31/12/2017 at about 6 p.m., when the complainant Seema was returning to her house from the market, on the way near Lord Hanuman temple at Khurai road, the applicant and co-accused Prince Patel and Bhagwandas Patel caught hold of her and took her into a four wheeler (jeep). On the way, complainant escaped from the jeep and hid behind the bushes and passed the night there. On the second day, she fell into a dry well due to fear of the applicant and co-accused. After hearing the sound of her screaming, the villagers came there and called the police, the police pulled her out of that well.
