(1.) Challenging the order dated 18.05.2016, the final result of Forest Guard Examination, 2015 and seeking a direction for appointment on the said post a writ petition was filed which has been dismissed by order dated 20.07.2017 which has been impugned in the present petition.
(2.) The learned counsel for the appellant submitted that the petitioner filled a form of the Forest Guard Examination through M.P. online as OBC female candidate. Being eligible for the said post, the respondent no.1 M.P. Professional Examination Board had issued the admit card Annexure-P/4. She had appeared in the written test held on 16.08.2015. It is submitted on behalf of the petitioner that as per the advertisement of the selection for the post of Forest Guard, selection was to be made District wise and the details of the post were given in schedule-I appended to the advertisement. She has filled up form as OBC candidate for District- Chhindwara. Since there was no post in OBC category in District Chhindwara, the petitioner's form was treated in unreserved category. The admit card was issued to her by the respondent no.1 and she was allowed to take up examination. The result of the petitioner was declared and communicated by the respondent no.1 vide Annexure-P/7 and the petitioner has obtained 57.33 marks. It is pointed out by the learned counsel for the petitioner that the last candidate who has been admitted in the unreserved category has secured only 57 marks. He has relied on a final result published by the respondent no.1 Board vide Annexure-P/1.
(3.) The respondent no.1 filed reply but the other respondents did not submit any reply. The Board has file reply and submitted that the petitioner has filled up form as OBC candidate but since there was no post in OBC category, she was treated as a candidate in open category and her case cannot be compared with a candidate of open category female. It is further submitted that since the petitioner has deposited fees of only Rs. 250/- along with the application form which was prescribed for a candidate belonging to the OBC and therefore, she cannot be given benefit of open category.
