JUDGEMENT

(1.) The original petitioner Premnarayan was appointed on the post of Peon with effect from 17.3.1978. On passing the Higher Secondary Examination he became eligible for consideration for his promotion to the post of Lower Division Clerk. His case for promotion was considered by the D.P.C. and on its recommendation he was promoted to the post of Lower Division Clerk (Assistant Grade III) vide order dated 29.5.1996 (Annexure A-2).

(2.) The respondents vide order dated 12.11.1998 (Annexure A-1) cancelled the said promotion order stating therein that his actual date of appointment is 2.5.1986 but the same has been wrongly recorded as 18.7.1975 and as such he was not entitled for promotion. Feeling aggrieved the petitioner filed O.A. No. 924/1998 before the M.P. Administrative Tribunal, Bhopal (for short 'the Tribunal').

(3.) On 2.1.1999 the Tribunal admitted the Original Application and stayed the operation of the impugned order dated 12.11.1998 by which the said promotion was cancelled and the petitioner was reverted. The Tribunal also made it clear that in case the petitioner has been relieved from the post of Lower Division Clerk he shall be permitted to rejoin on the said post.
