JUDGEMENT

(1.) Case Diary is perused. Learned counsel for the rival parties are heard. Applicant apprehends arrest in connection with offences punishable u/Ss.302/34 of IPC registered as Crime No.06/2016 at Police Station Pandokhar, District Datia.

(2.) Learned Public Prosecutor for the State opposed the application and prayed for its rejection by contending that on the basis of the allegations and the material available on record, no case for grant of anticipatory bail is made out.

(3.) Applicant apprehends arrest in connection with offences punishable u/Ss.302/34 of IPC where the allegation of murder is alleged against the applicant. Dying Declaration dated 23.03.2015 left behind by the deceased who died due to burn injuries is to the effect that co -accused Ram Kumar and Raj Dulaiya poured kerosene. There is no overt act alleged against the applicant.
