JUDGEMENT

(3.) This is the first bail application filed by the applicant under Section 439 of the Cr.P.C for grant of bail in connection with Crime No.193/15, registered at Police Station Jawa, District Rewa, against him and co- accused persons namely Kapoor Chand and Ram Narayan for the offences punishable under Sections 8, 21 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short "the Act"). It is a case of prosecution that on 21.12.2015, upon a tip off, informant S.L. Verma, the Sub-Inspector of Police Station Jawa, searched the route- passenger-bus bearing registration No. MP-17-P-0421 and found 99 bottles of Corex cough syrup (for short "the Syrup") keeping illegally in the boot of the bus. As per the label of composition stuck upon each bottle, it contains 100 ml. preparations with 10 mg. codeine phosphate which is a narcotic substance as it is salt of codeine, which is in turn a derivative of opium.
