JUDGEMENT

(1.) HEARD .

(2.) IN the FIR, complaint was lodged against Shakeel, Majid, Saddan Sikarwar, Rakesh Tyagi, Anil Tyagi, Anwar Khan, Pappu Khan, Wazid Pappu alias Asgar Khan and Babu Khan, but challan has been filed against Anil Tyagi, Rashid Khan, Sharif Khan, Ballu Khan, Majid Khan, Anwar Khan and Asgar Khan and has not been filed against the other accused. State is not in a position to explain why they have picked and chosen the persons for prosecution. It appears that this is a case of unfair investigation by police.

(3.) STATE is further directed to enquire and take action against the concerned for not filing challan against other accused who were involved in commission of the offence.
