JUDGEMENT

(1.) THIS Public Interest Litigation petition has been filed for a short direction to the Municipal Corporation, Gwalior regarding development of the park situated at Block "C" Chetakpuri Colony, Gwalior.

(2.) PETITIONER Arvind Agrawal is the Vice President of Red Cross Society, Gwalior. City Planner of the Municipal Corporation, Gwalior had written a letter dated 11.2.2004 (Annexure P -1) to the petitioner for development and beautification of the aforesaid park under Janbhagidari Yojna and an estimate of Rs. 50,000/ - was prepared. Petitioner, by letter Annexure P -3 has consented for development and beautification of the said park and paid a sum of Rs. 25,000/ - to the Municipal Corporation vide a cheque.

(3.) COUNSEL for the respondent Municipal Corporation is not present. He has not tiled any reply. On 17.5.2006 Shri P.D. Bidua, Advocate for the respondent Municipal Corporation was present and in his presence, it was mentioned that the pleadings arc complete and he was believed to argue the petition finally.
