THE Employees' State Insurance Corporation, saddled with the liability of the payment of injury benefit at the rate of Rs. 21. 00 per day for the period from 26/12/1981 to 25/3/1982, after adjustment of Rs. 140. 00 by order dated 31/12/1984, passed by the Labour Court (Employees' Insurance Court), Ujjain, in Case No. 354 of 1983, the Employees' State Insurance corporation in favour of the respondent, has filed this miscellaneous appeal under Sec. 82 of the Employees' State Insurance Act, 1948.
(2.) THE facts lie in a narrow compass. The respondent is the employee of Vinod Mills, Ujjain. He met with an accident on December 25, 1981, during the course of employment and sustained injury on the chest. He remained on leave on account of the disability caused by the accident. As the benefit was denied, he filed the aforesaid case against the appellant. The Labour Court passed the decree, as noted above. The appellant feels dissatisfied and has filed this miscellaneous appeal. I have heard Shri N. C. Behal, learned counsel for the appellant. None appeared for the respondent.
