(1.) Enough opportunities have been given to the respondent to file the return but they have not cared to file the same. The record of M.P. No. 1261/84 discloses that Gajju alias Gajanand had been undergoing imprisonment for life and he had completed more than 11 years and 6 months in jail. Govt. Adv. Shri Tamaskar had stated that Gajanands case was to be considered in the next meeting. This statement had been made by him on 12-9-1984. Shri Kathal is unable to state now whether Gajju alias Gajanands case has been considered in the Board Meeting and if so, to what effect.

In these circumstances, we direct that the application regarding release of Gajju alias Gajanand be disposed of within a period of three months and if the said application is not disposed of within the said period, Gajju alias Gajanand shall be released on bail on his furnishing a personal bond in the sum of Rs. 5000/- (five thousand) with one solvent surety in the like amount to the satisfaction of the C.J. M., Rajnandgaon.
(3.) This petition is, thus, disposed of accordingly. C.C. be supplied on usual payment.
