(1.) This is the husband's appeal against the dismissal of his petition under Sec. 32 of the Indian Divorce Act, for restitution of conjugal rights against his wife.
(2.) Appellant Hari Williams and the respondent Renubala are both Christians, having been married in the Church at Sagar on 28-12-79. They have a female child from their wedlock. The wife Renubala is not residing with her husband and is living with her parents only, since 5-5-81.
(3.) The case of the appellant-husband, in the trial Court, was that during the period while he and respondent wife were living together, the wife had been quarrelling with him and was putting pressure on him to live at Sagar only, where her parents resided. According to him, the wife was equally pestering him that she would take up some job which he must secure for her. It was also alleged by the husband that her behaviour towards him and h;s brother was far from being cordial, verging on misdemeanour. The wife was also alleged to have left his home on 5-5-81 of her own accord, with no intention to return back, and hence, his claim for restitution of conjugal rights.
