(1.) This is second bail application under Sec. 483 of BNSS filed by the applicant for grant of bail. First application was dismissed as withdrawn vide order dtd. 4/11/2025 passed in M.Cr.C.No.50264/2024 with liberty to renew the same after filing of charge-sheet.
(2.) The applicant has been arrested on 13/9/2025 by Police Station-Kachnaar, District Ashoknagar in connection with Crime No.260/2025, registered in relation to the offence punishable under Ss. 108, 238 of BNS.
(3.) As per prosecution story on 8/8/2025, at about 2:00 a.m., he had gone to the Siddh Baba Ashram, Jogiyadham. At that time, his wife Rekhabai Sahu was alone and sleeping at their house. The complainant further stated that a person from the village, Yashpal Yadav, contacted him on his mobile phone and informed him that an insect had bitten Rekhabai and that he should immediately return home. On receiving this information, the complainant reached home and, along with his relatives, took Rekhabai to Mungaoli for medical treatment. However, the doctor there declared her dead. According to the complainant, his wife died due to a snake bite. On the basis of this information, a Dehati Nalshi (rural information report) was recorded and Merg No. 24/25 was registered under Sec. 194 of the BNSS, regarding the unnatural death of Rekhabai.
