JUDGEMENT

(1.) Assail is to an order-dated 22.12.2011 passed by the Central Administrative Tribunal, Jabalpur Bench, Jabalpur; whereby, an Original Application No.509/2010 preferred by respondent-applicant, seeking direction for absorption in Grade Rs.6500-10500(RSRP)/9300-34800+Grade Pay 4600 in place of Rs.5500-9000(RSRP)/9300-34800+Grade Pay 4200, has been allowed.

(2.) Respondent, while working as Loco Pilot (Goods) in Grade Rs.5000-8000(RSRP) [later on revised to Pay Band-2 Rs.9300-34800 plus Grade Pay Rs.4200 with effect from 1.1.2006), was declared medically unfit on 12.2.2008; whereon, after being screened for alternative post, was declared suitable for the post of Office Superintendent Grade II (NP) in the pay scale of Rs.5500-9000(RSRP).

Aggrieved, respondent raised an objection and sought his absorption on the post of Office Superintendent Grade I carrying pay scale Rs.6500-10500 (revised to Rs.9300-34800 plus Grade Pay of 4600) on the ground that being a running staff, his entitlement on the alternative post is as per Para 1307 of the Indian Railway Establishment Manual (for short 'IREM').
