JUDGEMENT

(1.) Heard. Perused the case diary/challan papers.

(2.) This is the first bail application under Sec. 439 of the Cr.P.C for grant of bail. The applicant is being implicated in Crime No.262/2021, registered at police station Jawad, District Neemuch for commission of offence punishable under Sec. 8/15 and 25 of the NDPS Act.

As per the prosecution, on 9/6/2021 on receipt of a secret information the police party reached Javi Sarvaniya Maharaj Aam Road and recovered total 1 quintal 35 Kgs of contraband poppy straw from an Alto car bearing registration No.R.J. 27 C.J. 2722 which was lying in an unattended condition. Thereafter the investigation was commenced during the course of which the said vehicle was found to be registered in the name of the applicant on the basis of which he has been implicated and arrested for the present offence.
