JUDGEMENT

(1.) This is first application filed under Sec. 438 Cr.P.C. for grant of anticipatory bail to applicant, who is apprehending his arrest in connection with Crime No.95/2022, registered at Police Station- Mihona, District Bhind for the offences punishable under Ss. 34(2), 42 of the Excise Act.

(2.) At the outset, Leaned counsel for the applicant has drawn the attention of this Court to the order passed on 13/02/2023 in MCRC. No. 7248/2023 by which co-accused Ashok Kumar was granted benefit of anticipatory bail by this Court. The case of the co-accused person is identical to that the applicant herein, therefore, on the grounds of the parity, application is allowed. It is directed that if the applicant herein is arrested by the Arresting Officer, he shall be enlarged on bail upon his furnishing a personal bond in the sum of Rs.50,000.00 (Rupees Fifty Thousand Only) with one solvent surety in the like amount to the satisfaction of the Arresting Officer.
