(1.) Present petition under Article 226 of the Constitution of India is not directed against any particular order, but petitioner is aggrieved by the inaction on the part of the respondents in not handing over the full charge of the Accounts Sec. of Education Department, Karera, Distt. Shivpuri. Learned counsel for the petitioner at the outset submits that in pursuance to the directions issued by this Court in W.P.No.17532/2023 dtd. 25/7/2023 though the charge has been handed over to the petitioner, but in actuality she is not permitted to work as per the orders issued by the District Education Officer vide order dtd. 30/1/2023. A limited prayer has been made that suitable directions be issued to the respondents to hand over the full charge of the accounts department so that the petitioner may carry out her work efficiently.
(2.) On the contrary, Shri Khot appearing on advance copy for the State submits that from bare perusal of the contents of the petition it would be evident that vide order dtd. 30/1/2023 charge of the accounts department has been handed over to the petitioner and if still the petitioner is aggrieved by non-handing of full charge, she can approach the higher officials including the Collector of the district and make a request of handing over of full charge and under writ jurisdiction this Court should not issue such innocuous direction as on date it is not known as to why the full charge of the accounts department has not been handed over to the petitioner yet.
(3.) After hearing rival contentions, this Court finds strength in the arguments advanced by learned counsel for the State. Thus, this Court deems it expedient to direct the petitioner to approach the concerned Collector and raise all her grievance before him and if such a grievance is raised by the petitioner, the Collector shall take note of the case and pass appropriate orders in that regard. With the aforesaid directions, this petition stands disposed of.
