ANIL Vs. STATE OF MADHYA PRADESH

JUDGEMENT

(1.) This is the first application filed by the applicant under Sec. 439 of Criminal Procedure Code, 1973, for grant of bail during trial.

(2.) The applicant is facing trial in connection with Crime No.170/2023 registered at Police Station-Chapiheda District-Rajgarh, concerning offence under Ss. 376, 506, 354 (d) of IPC. Applicant is in jail since 13/7/2023.

(3.) As per the prosecution story, the allegation against the applicant is that and he has committed rape upon the prosecutrix. On the basis of which police registered the aforesaid crime.
