Learned counsel for the applicant wants to withdraw this first application filed under Sec. 439 of Cr.P.C. with liberty to file afresh in the week commencing 20/11/2023 or after the statement of seizure witnesses is recorded before the trial Court, whichever is earlier. Application is dismissed as withdrawn with liberty as aforementioned.
