YAGYA NARAYAN SINGH Vs. STATE OF MADHYA PRADESH

Decided On February 20, 2013
Yagya Narayan Singh Appellant
V/S
STATE OF MADHYA PRADESH Respondents

JUDGEMENT

(1.) THE applicant has preferred the present revision against the order dated 3.4.2012 passed by the learned Additional Sessions Judge/Special Judge, Sidhi in S.T. No.46/11, whereby the charges of the offence punishable under Section 466 in alternate the Sections 167 or 218 of IPC read with Section 120-B of IPC were framed against the applicant.

(2.) FOR the disposal of the present revision, the prosecution's shorty in short is that one Kusumwati was kept by the co-accused Virendra Singh and so many sale deeds were made in favour of the Kusumwati. In the year 2010, Kusumwati was found missing. A suspicion was created that she was killed. Thereafter, Virendra singh started to shift the property of Kusumwati in his name. A sale deed dated 7.8.2010 was executed, which was said to be executed by Kusumwati. But in the investigation, it was found that some other woman was produced before the Sub-Registrar of deeds and documents (the applicant) and deed was executed. Under such circumstances, the case of forgery was initiated against the main accused Virendra Singh and other accused persons including the applicant.

(3.) I have heard the learned counsel for the parties.
