JUDGEMENT

(1.) Arguments heard. This is a repeat application for grant of bail inter alia on the ground of delay in trial, pending as Special Case No. 36/12 before Special Judge (under Narcotic Drugs and Psychotropic Substances Act, 1985), Jabalpur. Previous one was dismissed on merits vide order dated 5-9-2012 passed in M.Cri.C. No. 6544/2012.

(2.) After being arrested in connection with Crime No. 256/12, registered at P.S. Garha, Distt. Jabalpur, in respect of the offence punishable under Section 8 read with Section 21 of the Act, the applicant is in judicial custody since 17-3-2012. Allegation against him, in short, is that he was found in an illegal possession of 10 gms. of smack.

(3.) In pursuance of the order dated 21-2-2013, learned Sessions Judge, after examining the record of the case, has forwarded the report indicating that not a single witness has been examined so far, despite the fact that charge was framed on 30-5-2012.
