JUDGEMENT

(1.) Heard.

(2.) Petitioner, a Senior Surveyor, Western Coalfields Limited, posted at Vishnupuri No.1 Pench Area, seeks quashment of initiation of fresh departmental enquiry directed by order dated 24.9.2012 on the same set of charges whereon a departmental enquiry was held and the enquiry officer had exonerated the petitioner of the charges.

(3.) That, the petitioner was proceeded against in a departmental enquiry with the issuance of charge-sheet dated 28.6.2011. The charges levelled against the petitioner were that in a vigilance inspection conducted on 9.6.2011 of coal stock at Urdhan O.C. Mine, 8.33% of shortage in coal stock was found and that the petitioner had failed to put into notice of the higher-ups regarding error in measurement conducted by him.
