JUDGEMENT

(1.) THIS petition under Articles 226/227 of the Constitution of India has been directed against the order dated 6.1.99 passed in O.A. No. 121/98 by the M.P. State Administrative Tribunal, Bench at Bhopal. At the outset Shri Sanjay Yadav, Govt. Advocate for the petitioners has submitted that the controversy involved in this petition has already been set at rest by this Court when the batch of petitions arising out of the common order have been decided. He has submitted that this Court vide order dated 19.7.2002 decided writ petition No. 876/2000 (R.K. Mehra and another v. State of M.P. and others) and other batch of petitions has passed the following order : '32. Resulting the order passed by the Tribunal is quashed. The matter is remitted to the Tribunal to be heard by a Bench in which the Chairman would not be a Member. As a matter of quite importance it is directed that the Tribunal shall bestow its anxious consideration to dispose of the matter within a period of two months from the date of order passed. 33. The writ petition is accordingly disposed of without any order as to cost."

(2.) IT is pertinent to mention that after the above referred order the matters have been disposed of by the State Administrative Tribunal and they again travelled to this Court and pending for consideration before the Apex Court. In view of these subsequent events in the cases arising out of the same orders, we are inclined to dispose of this petition with the observation that the result of the present case shall also be governed by the ultimate result of the matters which are pending before the Apex Court. Accordingly, we set aside the order passed by the Tribunal and this petition stands disposed in terms of the observations made.
