JUDGEMENT

(1.) PETITIONER in this writ petition is claiming for the relief to direct the university not to ask the petitioner appear in the papers of first semester of bca Counsel for petitioner has not pressed for relief made in Para 7. 1 as petitioner has passed 4th semester paper during the pendency of this writ petition.

(2.) PETITIONER was admitted to second semester in the Makhanlal chaturvedi Rashtriya Vishwavidyalaya, respondent No. 1. Petitioner has by now completed 6th Semester. Petitioner was required as per letter (P-9) dated 26-10-2002 to clear the papers of BCA first semester of Makhanlal Chaturvedi rashtriya Vishwavidyalaya.

(3.) IT is conceded by Counsel for the petitioner that there are three papers which petitioner has not cleared, but, submission is that the petitioner has disclosed the fact of passing of first semester from Rani Durgawati vishwavidyalaya. Thus, the respondents be restrained from the petitioner from appearing in the subject which he has not cleared.
