(2.) The applicant has been arrested on 19/10/2021 in connection with Crime No.255/2021 registered at Police Station Piprai District Ashoknagar for offence under Sec. (s) 363 of IPC and enhanced Sec. s 366-A, 370(4), 376(3), 120, 34 of IPC and Sec. 3/4(2) of POCSO Act.

It is submitted by the counsel for the applicant that after dismissal of the first bail application, the prosecutrix and her father have been examined and they have not supported the prosecution case. Even otherwise there is no allegation of rape against the applicant and it was only alleged that he had kidnapped the prosecutrix. The Trial is likely to take sufficiently long time and there is no possibility of his absconding or tampering with the prosecution case.
